First speeding ticket :(

    What are my chances of getting out of it? 76 in a 60 and he added on a suspended object ticket for my radar detector :(. Think the hearing officer will be helpful being that this is my only speeding ticket in 7 years? Or should I just pay it and shutup?

    Do you have to go to court? Probably not. I'd go in and see if they can do the 1 year no same/similar thing. 7 years, no speeding tickets, I think they'd be ok with that.

    I would take it to a hearing officer. It's worth a try. 7 years is a long time

    They will probably give you a option of paying $50.00 and for 6 months if you don't get another ticket it will go off your record and you don't have to pay for the ticket or you can defend yourself and go face to face in court.

    No, you pay about half the fine, but if you screw up again in a year, you get the hammer dropped on you.

    It was in Hennepin county, anything special about that county that would cause them to not be so nice to me?

    Hennepin sucks about tickets, the DA lady will not drop the point. I just went through this not long ago. THe best they do is reduce the fine. Good luck tho

    my story is even worse than goalies lol

    i got a PARKING ticket and they tried to take me to court for it! it was my FIRST ticket LAWLZ

    good thing i know a really good defense lawyer

    I was speeding, it was entirely my fault. If they honestly won't work with me even a little bit after 7 years of driving with a clean record, yet guys with 3 dui's pay a fine and avoid jail time, I will be mad :(. I hate getting nailed by the guys in unmarked chargers or unmarked's in general....they are usually the tightwad a-holes.

    Here are your options,

    1) Schedule to have a meeting with a Hearing Officer. Plead your case chances are they will lower the fine. The ticket will stay on your record for 5 years, in which case it will then be removed.

    2) Talk to a Hearing Officer about being eligible for their 1 Year Probation plan. In this case, you promise not to get any moving violations within a year. If, at the end of the year you received no infractions you don't have to pay the fine, the ticket is removed from your record, and you walk away.

    3) Pay the ticket, it goes on your record, leaves your record in 3-5 years.

    My Suggestion: Option #2.

    Side Note: I got a ticket the same day I got my license(yea yea, haha, funny, i know) for going 11 over. Option #2 is what I'm currently doing. I'm less than a month away from being free!

    Also, goto the Ridgedale office. If you go downtown your going to end up paying the fine in full, guaranteed ;)

    Stay away from Southdale hearing officers as well.

    I went over 13 years without a speeding ticket...then I got two, a month apart :-/ Go see the hearing officer. Take the detector off, take a picture of your windshield, and show them that you took it off. :) I've had plenty of luck downtown. They've taken off parking in handicapped spaces for me, and cut down a lot of parking tickets.

    Where did you get the ticket? It didn't happen to be on 694 around the university exit last night did it?

    ah ha...there was what looked like an unmarked silver one last night around 1am laser tagging everyone going eastbound. Scared the crap out of me when all my gadgets went off alerting me...sometimes I'm just so enmeshed in the driving experience :)

    What follow is a general discussion of speeding tickets in Minnesota. It is not individualized to your situation and is not legal advice. Legal advice comes from a lawyer you've hired. I'm not that.
    Hennepin county is really easy with speeds in general, though most of my experence in hennepin is Minneapolis.
    With a 15 over in Hennepin and a clean record, I'd put the odds of a Stay of Adjudication or Continuance for Dismissal/Continuance without Plea at over 90% as long as you weren't a douche to the officer.
    An equipment ticket reduces the likelyhood of this (and indicates that you made a bad impression on the officer)
    Always, always go in on your tickets unless the morning is worth ~$1-2k to you.
    Your first appearance with only an arraignment, the officer will not be there.
    If you don't like the offer, you can consider going to trial. At trial, you might get another offer (note that some attorneys don't give offers before trial), and generally, but certainly not always this offer is better. If offered something to keep it off your record however, take it and run, unless you're innocent. If offered a stay or continuance and it is turned down, it is never offered again.

    You also have the absolute right to have a trial before a judge rather than a referee.
    Also, in BP, you may not be in front of a hearing officer, but an actual attorney. He probably doesn't want to be dealing with your ****, but also may be more likely to givce you a good offer.

    you have a catch-22 with negotations: If you adnmit everything, you're more likely to get a good deal out of sympathy. However, you've just given up any likelyhood of winning your case and reduce the likelyhood you'll get a deal out of fear of a difficult trial.

    I am guilty as sin. I will readily admit that, the only thing I am looking for is a way to keep it off my record and perhaps reduce the fine. I have been a good boy for 7 years and had a lapse in judgement. I was not a douche to the cop, but I do believe he was not breast fed, due to the equipment violation when I was nothing but polite. I am essentially looking for a Stay of Adjudication, or a Continuance for Dismissal if I can get it :). What is the best way to approach this with a hearing officer/Lawyer?

    I've had decent luck with Hennepin county, including downtown. The city in which you got the ticket may determine which office you need to go to. In my experience they have so much other crap to deal with, if you just have one speeding ticket w/no priors, they just want to get you in and out quick, and not have you come back to waste the court's time.

    At any rate, it is always worth your time to at least talk to a hearing officer. The first ticket on your record isn't a big deal, the problem is if you get another one in 2-3 years, your record is now dirty, and it will be much harder to get out of anything.

    Also, as I understand it, the Continuance is not an admission of guilt, you still have the right to go back and fight it later (like, say, if you get another ticket within a year.) So if nothing else, it lets you drag the thing out as long as possible, which is also to your advantage.

    So essentially, I call the number and setup an appt. with the hearing officer. That meeting then determines if it ends there or I setup a court date, correct?

    schedule your hearing officer thing at the edina one, they are the nicest in hennepin as far as i can tell

    I'd have to go with Ridgedale being very generous as to letting people off. I was there a week ago with a friend. He had rear-ended someone in a work zone(394).

    They lady got rid of the work zone thingy, made it not show on his record, and all he had to pay was a $50 transaction fee or something like that.

    I hear ya man. I got a 100+ in a 70 2 years ago. was a 480 dollar ticket. That was after the hearing officer. Stayed clean for a year and its off the record. This was in Ramsey county on 35W north.

    I've done that whole year probation thing twice now...it's worked out both times. The second time, the hearing officer was awesome and completely understood my side of the story. The ticket was for careless driving and the officer claimed I did a burnout in the intersection, she could hear my engine revving, and I almost hit a pedestrian crossing the street...

    Basically, when she asked me to explain myself I told her my car is awd and isn't capable of doing a burnout. Second, I told her it was a stick and you have to rev it a little while getting into gear. After nicely explaining these to her, she just laughed about the whole "almost hitting a pedestrian" thing and said it was nonsense.

    From my personal experience, go in and be very polite. Don't be a jackass thinking the world is out to screw you.
