I am one that is all for the State Law against talking on a cell while driving a motor vehicle. While driving home in my truck to my Moms house in Richfield at 3:30am Friday night after work. I was gonna spend the night so i could drive my car to Morrie's in the morning. Well while minding my own business driving the speed limit going through a green light at 66th and lyndale. WHAMMM a homo in a Honda civic/accord on the cell phone blew through the red light and t-boned me. Even after hitting me he was still on the cell phone and didn't say a word to me........ Wow. That sucks! Same thing happened to my dad years ago. Only difference was a truck t-boned him in the station wagon he owned at the time.

Any better pics of the damage to your truck? Did the guy have his lights on, out of curiosity? How fast ya suppose he was going, 35mph? Even in a big truck like yours, the jarring effect can still effect you lots. :eek3: Out of all that, I forgot to say, what I was originaly going to say. SOOOOOO Now i'm pissed off... The dude that hit me is trying to say that I Ran the Red light... Now like anyone that has been in an accident, You think long and hard about stuff like this. And sometimes you can not remember. I was willing to be really nice about this whole deal... But Not Anymore... I have a witness. She saw EVERYTHING! She was stopped at the light when the guy ran the red light. DIAF jerk! I really now wish i could sue him for everything hes got.
Good to have a witness. Also, check if there's a camera at that intersection. Locally there have been a lot of CCTV cameras built at intersections to help with accident re-consruction. Unfortunantly regardless of how much evidence you have, his statment makes is 20x more likely his insurance with be a PITA.
But isn't the one who has the frontal impact at fault? I hope you win the case Brian but I am just wondering.
In this case the one who broke the law is at fault. I'm pretty sure. My witness told me that if they had a southbound green light, That she would have hit me or been in the accident also. And another thing he never hit his brakes until impact. So clearly he not been paying attention. If i had been the one running a red light he would have seen that and hit his brakes LONG before impact.
Yea police were on the scene right away and he even talked to the witness that night minutes after it happened. Even the cop said "Alright thats all i need to hear" I has head East on 66th and he was head south on lyndale
That light is always green headed east and west when there is no traffic, I take that street home at that time probably twice a week.

Get a copy of the accident report from the police and that will tell you everything you need to know about who is going to pay what. With a witness and a stop light, I'd be shocked if he wasn't cited for running the red. Glad you're feeling okay, but don't sign off on any settlement until you're 100% sure you're healthy.
Thats great you had a credible witness and the cops came to the scene. Same thing happen to me in Downtown MPLS years ago and the F'n Cops never showed up and the witnesses were pooh. Same scenerio, driver on the phone ran a red light hits me gets out of his pickup still on the cell phone all the while his horn is stuck blasting away. He even told me he just got his truck back from the shop. Our insurance ended up just fixing our own cars. Hope things workout in your favor.
