So in june this lady w/no insurance goes 35 MPH right through a red light and smashes into me here the pics considering parting the whole thing out due to need of vehicle. Apparently I have bad luck..and not enough sense to get collision coverage. Smart.. It also basically cost me my job as well. Awesome! Back 2 Square 1 :yumyum:
oh O' gotta get Maaco... I"m curious, it seems like these days when a perosn with no insurance hits your car and they're at fault, seems like all they get is a ticket or something that you have to deal with your own damaged car. One of my coworker was in a accident. A drunken lady ran into him and she got no insurance. All she got was DWI and a ticket. My friend? I guess its done deal if he doesn't have full coverage.
well i could technically take her to reconcilliation court and sue her personally. but that takes some time and she obviously has no money. I have the police report which includes her name, etc. Theres no legal action I can take with a lawyer unless she was criminally charged with something that i couldve gone after her for. The police didnt return my call when I asked and the lawyer I tried to hire never called me either! I sorta gave up on the whole thing.. Now I just need a crappy car. Anyone got a justy for sale? lol.. well yea when I part it out the rims will go 4 sale.. they have some falkens on them w/ only a few hundred miles too and the left rear tire is shot now
Driving w/o insurance is illegal, why can't you go after her with that? Don't let someone else ruin your life because of their mistake.
I would assume small claims court could work for this, but like was said, she most likely doesn't have much if she has zero insurance, that or she had so many traffic violations already where she simply lost it. What type of insurance do you have on the car? Just liability?
Get yourself a lawyer or talk to your insurance company some more. Same thing happened to my dad and I. Some kid (w/o insurance) was changing cds and rearended us doing 55 while we were turning into our driveway. My dad got 1,500 for his truck (1979 Gmc 3/4 ton 4x4). It wasn't the easiest thing and the kid's lawyer tried to pull some **** but eventually it worked out. Your car is worth more than that so I would assume are eligible for something. just my .02
Yes ^ I would keep working the little Bit@#$ over on the insurance, they really hate it when your persitant and don't give up. They'll settle and pay you just to avoid paying a lawyer. Give them a insentive don't hire a lawyer just yet just have one send them a letter that they'll have to respond to, this way they'll know your serious plus the letter is only $100, which may be alot if money is tight but if you get a check for $3000 it would be worth it........ just my .02 Cents
I've always wondered what happens if someone hits you with no insurance... I think u can sue them for damages, but it might take a while to get the amount back is she's a broke ass.. they'd probably just put a judgment out and she probably makes payments or has wages garnished... Hope everything works out for you, I know i'd be very bummed if this would happen to me
You can sue people all you want but in the end you will get more or less nothing. A judgement will go against the person until they pay and most likely if the person already had no insurance they will be a dead beat. If and when they want a loan you might get your money. I was rear ended about a year and a half ago in my brand ****ing new Acura RDX and the *****- had no insurance. She produced an expired proof of insurance card and the police let her go without a ticket, no citation. In the end I was out my deductable and this bitch still has not paid my insurance company. The debt is now in collections but as i stated unless she needs a loan or wants a house I likely wont see the return for the money i lost on the deal. Not to mention with it being in collections those ****ers will likely settle for half and who knows if the insurance company will actually pass anything on to me.
uninsured motorist coverage is REQUIRED in MN for this very reason... your insurance co should not be giving you a run around unless you have not purchased that ... in which case .. might want to get on it because I think you can get in trouble for not having it. right now, if she was a bitch and got a lawyer, her lawyer WOULD bring that up in court. Cheap cop out, I know, but that's how it is here.
