So on my way to the fair last night my foot was a little heavy. I know I was speeding but I got pulled over. Being nice and polite i gave my info and hung out. As the cop came back to the car and I knew i was getting a ticket i asked to see the radar/laser gun. He said sure. I walked back to the police car and the gun was blank and he said 'ohh its gone now, but it was 73 or 74".....I always go to court with my tickets. Should i plead not guilty and fight this one. I think i will be able to prove that he didn't have the speed becuase it should show on his dash cam, me walking back the police car and checking? and if it wasn't on the gun why should i get a ticket. Thoughts..Ideas..Advice? Thanks guys
Last time I got a speeding ticket, they said it wasn't required to be locked in the gun for it to stick.
Tough to beat it. I had a friend who brought an attorney to his hearing (court date), did a line up and the cop still picked him out!! He lost. If you can beat it ,share it with everyone. Sometimes they will reduce the speed so you don't clog their system, which helps with insurance.
It's tough to beat this kind of thing, especially with two confessions in a public forum thread that's only a few posts long. What are you thinking ?
Now that you admitted it, plea it down. Get probation. The last ticket I got isn't on my record. I got probation for 1 year. Three plus years later, no ticket and no problem. No insurance hike. And only cost me about $125. See the DA before the court date. **oh and learn how to 'not speed'.**
i'm sure they will look for it online :laugh: go see a hearing officer, or google search the discovery clause.
I've done this twice. If you can manage to not get another ticket within a year, it's like it never happened. There is usually a higher fine, but it's worth it. Seems like a much better option than fighting a losing battle in court.
Here is something....always fight it, in that my last one i got. I went to the city office and asked if there was a way to keep it off my record...after they looked at my record, i was placed on probation for a year. so basicly if there is a way to keep it OFF your record your insurance company will like that and so will you...
For good reason. No (well almost no) cop is going to fabricate the speed. Not worth the risk. There are other sources of error, but too many people focus on this. Where were you popped? St. Paul? Go to court. If you have anything resembling a non-crap record and weren't doing 20+ over you'll get offered a CFD (continuence for dismissal). It will cost you $224 (or it would have last year) and will keep it off your record. This will only be offered once. If you reject it, it is gone forever. Other cities and counties? Your mileage will vary. Anoka? Bend over, judges hate these deals and no one gets them withouta good reason. Urban Ramsey and Hennepin? Who has time for speeding tickets? Deal. What you want is one of four resolutions: Dismissal with or without costs -- You won't get this Continuance for dismissal without a plea (CFD, CWOP, or something) -- You pay a fee. Your case is continued for 1 year. You follow the rules and it is dismissed (you don't they may never find out, but don't risk it). You do not plead guilty (no record), but you may have to sign a statement admitting facts that will make you guilty. If you break the rules, you get a trial. Stay of Adjudication -- Pay a fee. You plead guilty on the record. The court stays adjudication of your plea so you are not found guilty. After a period 6 mo-1yr, if you follow the rules, you will not be found guilty and you will have no record. If you violate the rules (which they are more likely to find), you will automatically be found guilty. Plead to a non-traffic petty -- no record. Extremely rare. Some cities and counties will only do one or the other for traffic. Ramsey/St. Paul only does a CFD. Anoka only does stays. Over 20 mph over, get a lawyer if you want anything more than a dropped fine. Over 30 mph, careless/reckless box may be checked, and then you need a lawyer. Last year in St. Paul or parts of Anoka, I would likely have been his prosecutor.

My cousin is a defense attorney and he helped me out with a couple speeding tickets here are the two. Speeding ticket #1 in Wisconsin and that got changed to a non-moving violation. I think I paid $170, it shows up as a parking ticket to the insurance company. I think I was doing 70 in a 55. I got another speeding ticket about a year later in Michigan for doing 63 in a 55. He got that one changed to a $210 sealt bealt violation. If you have some one in that family that is a lawyer ask them and see if they can call the prosecuting attorney for the county you got pulled over in, from my experince they can usually work something out.
ok here is my experience. i also had this happen when i was like 17. i was totally speeding. the cop pulled me over at around 3am on 169 and said I was going 80. I was really going like 95, so i knew that he didn't have anything on me. so he starts to write me the ticket. me: can i see your radar gun and celebration papers that show I was going 80 mph. Cop: well i actually didn't get you locked in until 65 (it was 55mph back then, not sure if it still is) me: well if you don't have me locked in at 80 mph then you can't write me a ticket for 80 mph. cop: you are correct, I will write you up for careless driving instead MAJOR FAIL! went to court and got a 10 mph speeding ticket. my advice is to never argue and just take what they give you.
Depends on the city. Anoka judges hate deals, I hate to say. It takes nearly a perfect record to push one through in some cases. In some cities (Coon rapids being the big one) you may have been issued an administrative type ticket that basically bypasses the whole court system unless you want to fight allowing for no-record deals. Anoka judges are tough. Unless you get J. Askew,you may have issues. This doesn't mean it won't be worth going in though.
Usually i when i go to court i don't get farther than talking to the prosecutor. Will i be able to cut the deal with him? for just getting on probation for a year and paying a fine? or will i have to talk with the judge to get that kind of deal??
Its not my first speeding ticket. And i have a bunch of equiptment ones for no front plate and tint and stuff. I usually go to get the fine dropped down a little or show them a pic saying its all fixed to get it dropped. So i've been to court a few times.
In Anoka, the judge has to ok anything unless it is an administrative ticket. If you did you would probably know, as they would give you some paperwork with it, but I'd loo over that. If you have to go to court in Anoka, it occurs in two parts: 1. Arraignment. You'll show up at some time. Monday afternoon is CR and smaller cities, I don't know the other bigger cities calenders. Be prepared for trial at this point, just so you know the law. You check in with the clerk (be nice). In no particular order, you will be called to the back. The prosecutor will speak to you in the room. There's lots of tactics that can be used here, I won't get into them. One of four things will happen: -You will get a deal witha reduced fine, but it stays on your record. You'll be free to leave after some paperwork. -It will turn out that they scheduled you for the wrong city (common with small cities). This can be good or bad. The prosecutor may give you a sweetheart deal because he doesn't care. He may give you a **** deal out of respect for the other prosecutor. You will be given 2 to 3 choices: take the deal, plead not guilty and go to trial, and they may give you the option of continuing to see the right prosecutor as an arraignment. If you don't get a good deal take the 3rd option if offered. -You will be given a deal that keeps it off your record. Take this damn deal. You'll need to see the judge. - You will plead not guilty, proceed to step 2. Talk to judge. Step 2 trial! Well almost. You'll get called back to the prosecutors office. He will offer you a deal. This will almost always be better than the last offer (unless it keeps it off your record in 1). Fail to make a deal? Trial time. Again know the law. Wear something nice. The minute you gtet an offer that keeps it off the record, take it, it won't get better. Best parking for Anoka County Court house is a ramp on 2nd past jackson. Show up early. This is bigger than an equipment violation. No one gives a **** about those. We know we're being lied to and don't care. This is different.
My girlfriend got pulled over for speeding about a month ago and he didn't ask for anything but her liscense then he gave her a short lecture about speeding. Now a month later she gets a ticket in the mail. Can they do that? He never even said she was getting a ticket. The times I have gotten tickets they gave me a copy of it on the spot.
yup, ive gotten a few tickets like that. i didn't know that some of them speed things on the side of the road actually take pictures and record speeds...soo we were trying to see how high it would go..big mistake..
^lol. So even when an officer pulls you over he doesn't need to cite you on the spot. I don't really understand why it would be a month to send out a ticket.
it could be something in the system, like if he writes you a warning, they may over-ride his warning and issue you a ticket. Or the cop was just being a dick. I think its the latter.. the "oops i forgot to give you your ticket"
yes sir it was, near st cloud on some back ass middle of no-where long straight away. i take it when you get the thing to 99 in a 55 (i was over 99) they give you a ticket. me and two other cars got tickets in the mail from them.
the cameras are on those flash speed one that the cops tow behind there vech. and them leave them for a day or two. ask my neighbor who is a cop and he says that some city will send out a ticket if u are doing more than 15+. also if u are speeding in a school zone during school hours. which is where u will useally find these
I believe the cameras that the MN supreme court said were unlawful were the red light cameras, not speed cameras.
Necromancy! The decision should cover all camera tickets. Technically, cameras are not illegal, but the procedure outlined in the statute is (ticketing the R.O. based on plate number). If they changed it, it could be upheld, but it never has (and it would be much more expensive) at least before June, when i moved.
