    Speeding Ticket

    Has any one gone to fight a speeding ticket before, I have heard that if the cop doesnt show up you can get off, but what happens if he does show up, do you just have to pay the ticket? My wife got caught going 50 in a 35 and she already has 4 moving violations. It was in Blaine any idea about the prosecuter.

    yeah you just have to pay the fine and you might have to pay a court fee

    yep. Cop no show=Good for you/her. Ive heard the court fee is very minimal.

    Seriously though, if this is her 5th ticket you shoul have a talk with her, about how she needs to stop speeding.

    I dont speed, and if I have to get somewhere, I MIGHT go 4-5 over. Ask me how many speeding tickets Ive gotten in the last 4 years.

    i heard people said if we lost in the fight ...we only have to pay for the ticket but not the court fee....

    So if you fight it either way you probally have to pay court fee, win or lose.

    Only true if you go to trial. Your court date on the ticket is a pre-trial hearing. The cop doesn't have to show up. Seriously, best of luck go talk to the judge or the prosecutor and see if they'll give her a deal. With that driving record they may not be inclined to depending on the severity of her past tickets.

    ^ yep, if you call to contest it, your first meeting will be with a hearing officer or DA. You can attempt to work out a deal with them - this is where people get the probation type thing - no same or similar for a year and it won't go on your record. Court "fees" typically end up being a bit more (+$20-$50?) than the ticket, but that may be negotiable as well.

    Your best chance of getting a deal is if you have a clean record - that is why you start fighting with the first ticket, not the fifth one...

    If you can't work out a deal there, then you schedule a future date with a judge. I believe at that point you either end up paying the ticket, or nothing - it is your right to have a trial, that is why we have a justice system.

    hahhaa...i cant see any court day on the ticket anyways ..i got the ticket like a month ago and it just showed up on the record, so i have to pay by the 23rd....well ...this is my second ticket...im still thinking should i just fight it or not

    if you fight it you have to go in and set a court date at the preliminary hearing. at the second court date is when you gotta hope for a no show by the cop this is also when you might have to pay a court fee and if you have 4 tickets already its tough fighting the ticket your best chance is to just get the ticket dropped to a minor speeding ticket instead its pretty tough to get a ticket that large totally dropped. good luck with everything

    the last one i went to fight.... 85 in a 55, and endangerment of life and property, a misdemeanor. went and got the bad thing dropped and paid the speed only and was on driving probation for a year.

    but they went off the police report even though the cop wasn't there

    they go by what he wrote on the back of the ticket. the part that they dont show you.

    every ticket i've gotten i've gone to a hearing officer down town saint paul right by savoys on 7th, its worked out better for me every time.


    as having 4 tickets or something theres NO way they will let her go on probation or anything i'd SERIOUSLY disappointed if she didnt lose her license

    NONE!! I havent even gotten any going 5-10 over... if you are gonna speed be smart about it... in small increments and only on highways with other traffic... going 50 in a 35 zone is just moronic... sorry but how the hell did someone get a licence if they cant read a speed limit sign.... and if she DID read it and still speed then sucked in.. stop whining and tell her to wake up... especially somewhere that calls for a slow speed.. usually means there are kids or people walking around... why the hell you speeding in that zone... why not just drive you car through the mall...

    Nate, I'm glad you're not ripping on anybody, given that you operate a licensed shop but drive a car without a cat, in violation of Federal law. :laugh:

    People brake the laws they don't care about or respect. For example, I noticed North Dakota is finally going to change their law so cohabitation is not a crime. :roll:

    hmmmm breaking a hippy law as opposed to speeding through a slow traffic area... BIG difference...

    like comparing raping a woman compared to looking at one.... technically you may have undressed her with your eyes, but you havent hurt or violated her...

    sorry buddy but unlike cigarettes and 2nd hand cat stink, my catless car hasnt killed someone unlike a speeding moron through a slow speed area has killed many... and although it is a FEDERAL law, they DONT test here yet... unlike radar guns in cop cars, may be used all over the states and guess what... THEY ARE HERE TOO!!!! so your point... other than I am catless and if you want to get real technical yes I too am breaking a law... hmmm guess anyone who has modified their exhaust from stock, their ECU, their INTAKE yada yada... have all broken rules made by the government...

    I am not ripping on someonme if what they are doing has been stated as fact... they have admitted to their stupidity.... I just added my 0.02c




    ps.. I am contemplating putting A cat back in my car... but the RSPCA may sue me for having a frozen house pet in my trunk.... hah ah ah a.. sorry i was serious until I started writing it and couldnt resist...

    The truly residential streets are 30mph. 15 over there would be a problem. But there is a section of 4 lane near me that is 35; it looks the same as the section that is 40, and similar to the road you turn onto it from that is 45. If you aren't familiar with the area and relying on other cars for a clue you could easily be up to 45-50, lots of people speed on that road. Obviously they love setting up speed traps there. Imho, if they were serious about safety, they might put up a bigger speed limit sign, add some of those bright orange bands to it, whatever. Maybe you get distracted by some other driver and happen to miss the one speed limit sign before the trap.

    Not justifying the ticketed party (with 5 tickets there is obviously a problem) but at the same time I think there are circumstances where 50 in a 35 may not automatically warrant a death sentence.

    I never said I NEVER speed... I have hit triple digits I think ONCE with TOM while data logging... (115mph -he said go till you are comfortable, I was still comgf=fortable till he looked up and screamed that will do) the highest I had ever been in my WRX was 85 on a HIGHWWAY not a residential gping to like IOWA overtaking traffic...... and yes there are some lower speed area on roads that are highways but they arent open 4 laned roads generally!!!

    pot calling the kettle black is one thing, but making an open ended statement to a posting that says the person has had 5 speeding tickets and they are trying to work out how to get out of it... EASY STOP FUGGIN SPEEDING!!!

    in 5 yrs here i have NOT had 1 speeding ticket... in fact in 15yrs of driving I have had 1 speeding ticket (in Australia), 1 Reckless Driving (sideways back and forth int eh wet in my 13B RX3 for about 400meters), and a couple of defects...(tickets for locked diff and bald tires)

    I got pulled over once here for speeding... late at night after a 13 hr work day in a back road in chanhassen, rolling down a hill in a 30zone doing 42!!!! cop gave me a warning cause I WAS POLITE and FUNNY with him... and didnt try to bull**** out of it... and the only reason I got a warning ticket was cause I had the wrong insurance card in my car... my updated one I put in my wifes car by mistake.

    I aint a fan of skreet racing, but have I done it... YES!!! have I done it here... maybe once.. but I cant really recall when or where... Oh yeah with Bill frum a roll ont eh way to the ice races.... went to 80mph I think...... oh noes!:eek3:

    but you WONT catch me speeding in a SCHOOL ZONE, or really through a residential... technically I do cause i go 5mph over almost everywhere I drive... so oops the pot got blacker I guess....:roll:

    My wife has 4 moving violations in 3 years,the speeding ticket she got, the road goes from 45 to 35 and then back to 45 in about 3/4 of a mile. The other violations were dumb but not moronic, i.e. waiting in a turn lane behind another car at a dead stop with out blinker on, she had the blinker on to get in the turn lane, but turned it off while waiting to turn. Other one was went into turn lane to turn left, decided to go to next exit and went out of turn lane( with her turn signal on) and cop was in a bad mood, and this was at 4am no one any where near when she went back out of turn lane.Th eother one was changing lanes without blinker. All her fault and illegal but kind of technical tickets. But who am I to talk I just did 120 down 610 in BP on the way to work this morning, Ha Ha Ha. If you guys wanted to earn extra money you could start a driving school, because any one as perfect as some of you guys should teach others perfection as well, I would like to sign me and my wife up first, where do I send the check.

    Your not going to get it dropped, but you can try and get it for 10mph over the limit instead of 25mph. If you can get a hearing officer to do it. then that ticket will not show up on your driving record. Granted you still have to pay the fine.

    The fastest I've been was around 140+mph from what I can remember. Only have done it once and my car was floating *scary* and my wife was in the car too. I know the car can do more, but I backed off it was already a scary moment...It was on 610 towards BP...Straight Drag clear day w/my radar on alert...

    Since when does someones max speed justify what they should drive? I won't go much over 80mph 99% of the time because there just isn't a justification to do so. My personal thought is that anything into the triple digits is just plain unsafe and downright dangerous on a public road. Does everyone share my thinking? No. Have I ever done it? Yes, I have opened up on a couple of deserted interstates. The last few years have been an eye opener for me, once you've done a couple of extrications you start to see the folly of stupid driving and the other side of what happens. I've been there when a family was notified that a member was killed, and it's rather sobering, to say the least. It kinda sticks in my mind when I get the urge to start doing stupid things on the road. I'll keep my triple digits at the track, where it's controlled and a rescue crew is on standby...

    How about we all just take a deep breath and relax?

    I've been through the speeding ticket wringer more than a few times out here in Anoka county. You're probably not going to have much luck getting that one dropped without a spotless driving record. One of the ones that I tried to fight the prosecuter made a point of announcing that he "absolutely does not make deals to keep violations off of anybody's record"...on the suspension front though heres how that shakes down:4 moving violations in a 12 month period nets a 30 day suspension, 5 in 12 mos.=90 day suspension, 5 in 24 months = 30 day, 6 in 24 months = 90 day. It's not fun once you get yourself in this cycle(basically, this behavior is why i had to wait until I turned 30 to buy my WRX to afford insurance)...I'm not saying I never speed, but now it's just for fun, and not because I'm in a hurry to get somewhere.

    And for your original question, if it actually goes to court the officer will recieve a subpoena and if they have the time they will go to court. Their court dates will be scheduled into their work calendar. I hate to say it, but your wife probably doesn't stand much of a chance with the prosecutor because of her prior record.
