unreasonable acceleration???

    i was rippin around in a parking lot yesterday with a buddy of mine in his audi and we both got cited for unreasonable acceleration... he said he saw us but i was parked when he pulled up so i'm fightin it... so i guess i learned to stick to nieghborhood drifting where it's safe and full of pedestrians... i hate noob cops

    Un reasonable accelration has various specific guidelines if i recall...
    the big ones are squealing or spinning the tires. otherwise it's a cop's judgement.

    You can go and fight it on the basis that not spinning your wheels in the snow is almost impossible, and downright absurd. but i don't think you'll get very far.

    Keep in mind, this is all what i remember from second hand sources.. it's probably totally wrong.

    The statute number should be on the ticket, so just google it and see how it's defined.

    i am kinda surprised he gave you an acceleration ticket. wouldnt something else be pertain more to sliding around a parking lot such as careles or reckless. i am not up on my rules so i am not sure what constitutes each.

    your screwed and thats that. pay the ticket and get it over it. when we do stupid things and get caught. its our own fault.

    but you can say that you were testing out your car to see how it handles in this kind of weather and how to react to what may happen in city streets. say the news told you so. because they did. kstp to be exact. they said go practice in a open parking lot so you can have a feel for it.

    no reason to insult him, to say you havent gone sideways in the snow is total BS, everyone in MNsubaru has fun in the snow. Matt, fight the ticket, it will either get thrown out, or at least knocked down a few $$$

    Yes go to court. If you have a clean record ask the judge for a same or similar. Expect to pay the fine but try to get it to stay off your record. Talk with the prosecutor not the judge if possible(they can make deals with you). Always always always go to court!!!!!

    Ok in the good chance of being told off for sayign it but doesnt anyone in this country take resposibility for their stupidity???

    I mean your avatar even says the reckless... so if you drive recklessly in a parking lot (public accessable or private (unless you own it)) then what else do you expect to get if you get caught... Fuji ripped donuts in my shops lot after the install... if a cop had off tried to book him I would have told the cop to leave as he had permission to do it on MY (private) property.... but if someone rips arse in my lot without my permission and they were a jerk to me in my store I call the cops...

    damn what is up with people...

    Quit stereotyping Americans! I hear so many complaints when I travel in Asia about how Americans like to stereotype, now we have Austalians, which are very welcome to be here BTW, adding to the perception. Just because a few people choose to fight a ticket for what they did (in this case, it was the wrong ticket handed out, IMHO), that does not imply that I do it.... Get off your high horse, I am sure nobody in Australia ever fights a ticket they deserve! :roll:

    Anyway, back to your regularly scheduled programming.....

    Nathan, I hear what you're saying. What I'm talking about is forgiveness. Yes people screw up and are responsible for it. I'm not debating that. If he has priors the judge is going to throw the book at him regardless. He will pay the fine whether he gets the ticket or not as well. What I'm saying is a lot of people don't exercise their rights. I'm not saying he should take it to a jury trial which pisses people off and is a waste of time and money. He should go to the pre-trial hearing and talk to the prosecutor though because he may be able to keep a clean driving record and not have his insurance find out about it. Its the difference between a slap on the wrist vs. a slap on the wrist and a swift kick in the ass. If you can avoid the latter I would recommend doing so becuase all the county wants is money anyways.

    make sure to be nice in court... if the cop really did see you guys and has witnesses or on tape, it could be considered reckless driving as well...

    lets give him advice, not personally attack eachother. fight it, the worst that could happen is you hafta pay what you already knew you had to pay, they cant make you pay MORE.

    "you can do it!" I believe it was July 1st of last year that unreasonable acceleration was considered "racing" in the law book. I think it's a dumb law, but it's an open law that is based all on the perception of the cop. It's fightable.

    ALWAYS, ALWAYS fight your tickets!! 90% of the time you will get a "no same or similar" and a small fine.

    It seems to me that such a law would be unenforceable in the real world. All cars have speedometers, which, if properly calibrated, will let us know when we are speeding. If we are speeding, we can take steps to slow down, and stay within the legal limit. We don't have to guess our speed, and the limits are usually clearly posted.

    Unless the law makers plan to give out GTech Pros to every driver, so they can quantify how many m/s^2 they are accelerating, and stipulate a limit on how many m/s^2 is an acceptable rate of acceleration on public roads, this kind of legislation is merely another in a long line of fund raisers.

    In theory you are right but the court will always trust the cops judgement even if he didn't clock you speeding. They go by whats in the cops report. And if you took it to trial its your word against the cops(ie you will lose).

    thank you for the positive advice... i pretty much have to fight it cuz if it goes on my record i may be out of a car or just get raped even more on insurance... i'm gonna use the kstp news story as my excuse...

    go talk to a hearing officer...most likely they will do the whole probation thing...you pay a little extra and it doesnt go on your record, but you cant get another moving violation for another year. However, if you did get another ticket, you could just do the same thing and nobody would be the wiser cus your first ticket doesnt show up on your record (before anyone bitches at me for thinking i fooled the system...this is what the hearing officer told me to do)
