"Getting sued... for car getting broke into...

    --------------------------------------------------------------------------------

THIS SUX!!!!!! I caught some punk ass kids trying to break into my car at Mall of America in the ramps, and me and 2 of my friends chase them down and whoop the shiet out of them "excuse my language, i'm mad." Well i guess we hurt the two kids a little bit too much, that it caused broken bones and such, but i mean, come on... who wouldn't be mad if their car window got bashed in???? Well anyways... cops and security came, grabbed me and threw me onto the ground screaming at me, telling me to stop resisting... i'm like WTF they damaged my property and i have no right to do ANYTHING about it??? The **** cop says SHUT UP KID... i'm soooo angry right now. And to top it all off, the kids parents are pressing charges against me and my friends, this is one F'ed up NIGHT!!!!!

Oh i hope i dont get in trouble for breaking the kids collarbone... this just isn't fair."

Sucks. Unfortunately unless they threatened you with bodily harm or attacked you first you can't use that sort of retaliation. I know that if something happens due to a crime in progress that it is compounded on the criminal. Dunno if that applies to that situation but basically it would mean that the kids that were breaking into the car were in the process of committing a crime that they were responsible for the outcomes of what they were doing, in this case getting a severe whuppin. I'm sure there will be charges on both sides for this one though [xx(]

Dang, I'm happy those punks got what they deserved. Sh*t like that happens all the time.

Sadly, I dont' think that guy will win the case. First, he's a legal adult and the mutherf*krs were 16 and 17... minors. Second, they were trying to run away without the intention to harm the owner or the owner's friends. Third, the MF'ers were beat pretty badly.

For example, if a man breaks into your house and is walking out of your house with your TV, you cannot shoot him to stop him before the authorities show up. He is then a person that is shot by you and you will get sued. Only when you warn him to leave but yet he intends to inflict bodily harm on you, your wife, or your kids is the only time you can shoot him. ...and if you called the cops afterwards and told them over the phone that you shot someone, you just turned yourself in and they have recorded proof that you shot a man.

Sit down before you hurt yourself... have you ever heard of dead man can't talk?

If anyone, break into my house... I'm sure s/he'll get a lead full and then some. Shoot first and ask question later, if s/he can still answer that is }:)

In my carrying and concealed class, the County Deputy said to avoid getting sued by the thief, make sure s/he don't talk when you're done shooting. If you can't accomplish that... you're screwed.

Yes, I have a heart and a soul and I would feel bad taking someone elses life... but the good of taking that bastage out of this world weighs more on the good of my family.

    Ya Vic, perfectly reasonable.

Attempted theft or destruction of personal propety = physical harm and/or death.

Stuff is stuff, it can be replaced, life is life, it can't. Stupid kids do stupid stuff all the time, it's unfortunate and hopefully they learn from it.

I'm not condoning the reprehensible behavior of B&E or theft or destruction of property. I hope the kids that broke in get time in Juvi and that they have to pay financially for all the damage they did. The owner should be fully compensated. However, beating the crap outta them risking possible death is not reasonable, and the law agrees.

    Yep, what he said.

Someone breaking your window does not give you any right to beat the crap out of them. Sure it makes you angry and want to kick their ass but that does NOT make it right, justified or as stated above not reasonable. Clear cases of not thinking before acting. Dip**** kids should have thought about the consequences of their actions and so should the guys who thought it was neccesary to break some kids collar bone.

What if you chase, catch, and restrain the person while the police are coming? (without hurting the person)

    That's all good.

Though, FWIW a bad idea as it escalates the situation. IE, what if they pull a knife or gun on you? We aren't trained like Police Officers are for detaining people, and there may be other liability issues.

Of course we would like criminals to own up to what they've done, but sometimes you just have to say "stuff" happens and file an insurance claim.

It is odd how the most of the Subaru persons are taking the more passive aproach to this matter saying that the guy should have detained but not beat ass on the kids. All the Mazda guys are totally out for blood. Hm... Adult view vs. Kids view?

Yeah if your really gonna end up seriously hurting someone (that broke into your home) your better off killing them, Less BS to go through the rest of your life. I read somewherew about someone that ran someone over and made sure the person was dead so they couldnt sue. But then theres the persons family. Oh well what can you do in this screwed up world. :(!

Modern Forensics has improved so much over the years that they can find out if the weapon used to kill the invader was done with intent. Fingerprints make great evidence used in court and cleaned up blood (if you were dragging a bleeding/dead person) can be found. That means, if you shot the guy in the back and dragged him into your home, you're f*cked. You'll get charged for changing (for the lack of better wording) a crime scene, and that is serious. ...but all this that I speak is out of my butt. I have no facts, just from what I have heard from conversations with a NRA co-worker.)
