Got a ticket going 79 in a 50...damn. Never had a moving violation before, one petty misdemeanor for minor posession of alcohol (over the age of 18 for both of these). any advice? is my minor going to nullify my chances of going to court and being put on probation? Any way to prevent insurance from going up? any help is appreciated as i have no knowledge of what to do....
What i did on my first Ticket was talk with the prosecuter and see if he let you slide with a one year NO SPEEDING then it'll be off your record. What i did was explain my reasons then he just told me that if I could go on one year without getting another one it'll be off my driving record. During the one year term this ticket will not show up on my driving record. It'll be hiden but if I get another one, it'll have double impact. Don't know for sure if he just saying stuff to me or for real but thats how my case went. This was in Wisconsin.
Will only if your driving record was clean for amounts of years. I got a speeding ticket 2 weeks ago and the officer told me that my record was clean for 3yrs and that I should go meet a prosecuter to be put in a program just like what Ej20 said. The program cost $25.00 and you paid the ticket too. But if you get any other tickets between that year then the speeding will show up in your record. John
Go to court and fight it, you will most likley get a "no same or similar" for year. Pay a fine and you have no ticket on your record if your good for a year. I've done this MANY times
I was under the impression of this too... I got a ticket for going 1-10 over on I35 by the lino lakes city pd! I figured i could get it dropped or at least not on my record for sure. I waited 4 fricken hours in a court room and when i finally talked to the prosecutor he said "yeah you'll just have to pay it." He wouldn't give me any cuts or breaks or even let me plead my case. He said it would stay on my record too. I had never had a ticket in minnesota. I tried arguing a little and he said "i'm sorry you made the long drive, but you have to leave this room now." I guess different court systems work differently, good luck and I hope it wasn't in lino lakes!
If you get caught going 1-10mph over, it doesn't show up on your record regardless. Eitherway, go to court, whats the worst that can happen? you have to pay your ticket fee anyways?
Yeah, you got screwed. My insurance company (progressive) told me that if a ticket is submitted by the courts and it is for 1-10mph over it is not put on my record. I have gotten 5 speeding tickets for 8, 9, 9 ,9 10 over and none have gone on my record. This has been in the last 3-4 years
so 1. do you think my minor will affect this? or maybe not? 2. court is july 11th got the ticket yesterday when will this hit my insurance, right away? after court? when i renew my policy?
For the 1-10 over there are two ways the ticket can be filed, one will go on the driving record, the other will not. It's at the discretion of the citing officer. It's something like Statute xxx.0 vs Statute xxx.1, or at least was the last time it mattered to me.
Only one way to find out. Since it's not a similar offense, I'd guess it's not going to be an issue, but only the hearing officer can tell you that. It's not going to hurt you to go to the hearing, worst case, you just end up paying the ticket anyways. The ticket could show up for your insurance anytime after the decision has been made and the records processed. But it won't until the insurance company does a review of the records, which depends entirely on the company.
I don't know if your minor will affect this or not, it's going to depend on the mood of the prosecutor and the judge. The thing that's going to hurt is the fact you were doing almost 30 over, they may not want to be very lenient about that one.
go talk to a hearing officer, they can probably drop it my friend went the day after he got his ticket (and it wasn't his first) walked in, spoke to the hearing officer, and it got dropped he got another one, went in, the guy dropped his fine to a low amount.
What county did this happen in? And I highly doubt they're going to drop a ticket for that much over.
:eek3: That's not going to help. 30 over is a hefty amount. What you are looking for is a "stay of adjudication" and is completely up to the hearing officer or prosecutor. Go in, tell the truth and ask for that. Having a clean record may or may not help ya here. ..and for the record, any speeding ticket you get goes on your record. It being visible or counted against you by your insurance company is another story.
I highly doubt the minor will effect it since they are vastly unrelated (unless you were driving when you got the minor). I would count yourself lucky right now, since for anything over 20mph over the limit you can loose your lisence for 6 months. go talk to the hearing officer. since this is your first moving violation you should be able to get it on prohbation. hen drive slow for another year and it will be off your record. keep in mind that alot of the time the officer will demand that you pay more, sometimes double, the ticket price to get it prohbated.
I'm gonna have to agree with you on that. Go to court though, your worst case scenario is you take a morning off work and have to pay your ticket which you already got anyways. I saw a girl walk off with nothing on a dwi when I was in traffic court(she had no moving violations previously). When they read the arrest report they pulled her over for driving through peoples front yards and running over a bench.
The 1-10 over technically only applies in a 55mph zone, because it was originally written when 55 was the max speed limit. One could argue that the spirit of the law is such that it could apply to anything 55 or over, but unfortunately it means no freebies on most freeways nowadays. A law first enacted in 1986 known as the “Dimler amendment†(after its author, former Rep. Chuck Dimler) governs which speeding violations are recorded on a motorist’s driving record. The Department of Public Safety maintains the record. Speeding violations are not placed on the driving record if: - The driver was going no more than 10 m.p.h. above the speed limit in a 55 m.p.h. zone; or - The driver was going no more than 5 m.p.h. above the speed limit in a 60 m.p.h. zone. There is no prohibition on recording speeding violations when the speed limit is 65 or 70 m.p.h.
Well well, consider yourself lucky sir. How much did you have to pay a lawyer to get out of that one, and miss how many days of work going to court?
Yeah, talked to my insurance my rates will go up by $25 a month with a ticket, which inst the end of the world its a 15% increase but it could be worse. Thanks for all the help guys, I don't really know what my chances of this one getting dropped are so I think i just might man up and pay the $282 fine. And just so you all know, the reason I wanted to get out of the ticket had nothing to do with me thinking the cop is wrong. It all had to do with my insurance rates. This cop was right, and he had good intentions. He sure did read me the riot act though, some story about a car full of kids speeding on the highway crashed and they all died, and guess what they were in a wrx too. I guess the moral of this story is, if your gonna speed, don't get caught or at least be prepared to pay the ticket. Thanks guys.
don't just pay the ticket!! at least go to the hearing to TRY and get it dropped some. Usually they will at least drop the speed a little and give you a break on the ticket price.
go in an plead guilty in person and ask for a continuance for dismissal, then don't speed for a year. It wont go on your record. /thread
i got a 56 on a 30 and it was my first offense 2 years ago, i got screwed over and never had a chance. paid, went on my record....end of story.....good luck!
