well i got pulled over friday night city of medina, for not completely stopping at a stop, first car stop and then went, so i saw the car to my left stopping before me, so right of for him, so I had to stop, also i have 3 witness state that I did. He gave me a ticket but state the wrong car, the ticket was saying it was a 97 civic with so and so license but civic doesn't look like a subaru wrx lol. this is my second ticket on this car well one because ticket state a civic not a wrx. I'm going to court or a hearing office and was wondering if I should state this mistake and help me get out of this ticket... or I should leave it on the civic because that person is the one that brought us out there and didn't film any scene. should I bring those witnesses? any advice?
I don't have any advice for other that reread your post and figure out that it is really hard to read and follow.
give him a BRAKE... (spelled wrong on purpose) he is from the Honda scene.... ha ha yeah.. sentence structure can be your friend... I would say take it to the hearing officer.. clearly states the wrong car.. give it a shot.. worst thing that could happen is you pay the fine that you have to pay anyways
at least you could get a smaller fine. But considering you have to wait like 4 hours or so at court. Cops are allowed to mess up a little despite what you hear.
Wait, is the ticket for YOUR CAR, with YOUR LICENSE? If the ticket is not for your car, then you don't have a ticket...and don't have to do anything. If you want to be nice, you could bring the ticket in to the local courthouse and explain the story...
i think what he said was he got a ticket that said it was for a civic but he was driving a subaru...the license thing is probably just stating what type of license he has
If it states the wrong description of the vehicle thats a means for dismissal. You'll want to bring it in to the municipal court plead not guilty, go to the court date they give you and ask for a dismissal on terms of the ticket being wrong.
No it doesn't. Not if the plate and the license numbers are right. OP, I can't even figure what the hell you're saying. The definition fo stopping is the wheels ceasing to move. lots of people think they've stopped when they really are doing like 2-5 mph.
i used to live out in the medina area, and the cops are really picky about stopping at stop signs, i got a ticket once for, and i quote, "my taillight not being red enough." Try talking to the hearing officer, who you will have to see before you take it to court. If you have another moving violation chances are they will not throw out the ticket. If he wont do anything for you, you can always try to take it to court. One of my good friends has a mother who used to be a D.A, according to her, when you take cases to traffic court, most of the time they are willing to work with you and reduce the charge. The prosecuting attorneys HATE traffic court cases, they find them extremely boring, so they will usually make you a deal to get you to plead guilty for a lesser charge. Don't stand by the rule that if you take it to court and the officer doesn't show up you throw out the ticket, with Medina cops they ALWAYS show up. So i wouldn't advise taking it to court and hoping for that outcome.
Hmm, then it must be different because I have heard a few stories of it being dropped due to errors written on the ticket including wrong model/type.
It can be a factor. But it isn't an automatic drop. Hell the ticket isn't even evidence. All those are are for notes for the officer to testify about. If he testifies he stopped a civic, you might have a deal. You're also going to have a hell of a time explaining how it wasn't you who got the ticket, yet somehow you know details of the stop.
He stop me, but the car in the ticket is wrong. Not even my plates. It was a complete stop, because the officer had the right of way to go. I stop after them. The ticket would still be under my name, would this raise up insurance even if the car is stated wrong on the ticket? I'm taking to the hearing office this Friday, hopefully he just let me off. Hopefully I don't have to go to court.
Wrong plates? That makes it harder for them. If your license number is correct, they could win in theory. Anymore is legal advice and I'm not give any.
