insulted by a police officer. what can I do?

    Me and the boys went out last night for a little deep snow fun and wound up on our favorite lot... When we arrived a plow was currently leveling down the lot. I believe its a private lot, and we frequent the lot in the summer time and hang out.... the plow driver sees us, lifts his plow, and drives by the car and says "if you guys want to mess around for a little bit I can go do the other lots and come back in an hour or so" we give our praise to the plow guy and have some fun.

    we played around for about a 1/2 hour or so had our fun and were talking about where we wanted to go for food (we were standing still for about 10 - 15 minutes) when we were stormed upon by cherrys of the armed forces. screaming over the loud speak to roll down our windows, and pull our keys out of the ignition. I think last night was about 15 below.... so all of us did.

    in crazy cold weather pulled the keys, and rolled down both windows.
    the cop with a seemingly bad attitude without even an attempt at being civil announced we would all be getting tickets, and would be lucky if we kept our cars. When he got to my window and asked for my license and reg. i handed it to him.. in a very snotty voice looked me sternly in the eye with his flashlight and asked "and how old are you!" I said calmly "28" hee responded right back with "28! you should fkn know better!" I said "excuse me?" Then he went on a rampage about putting me in the back of his squad if I wanted to give him attitude. The other officer who showed up saw he was lipping off to me and thought I was being unruly or something and joined in on the "this is what we can do to make your life miserable" speech.

    so after our public nuecence(sp) tickets were handed out I called out to the nicer officer. explained our situation in a very calm manner and kept it professional. he almost looked a little sad about the event and said there was a call that came in from across the street about noise from the street.

    so I apologized to the guy and said we didn't mean to cause trouble and would have left had we thought we were disturbing anyone. so they all got in the squads and started to leave.. when the first guy gets back on the mic and says something about leaving the god damn parking lot no or we'll all be arrested" as he quickly leaves.

    now out of all my years of dealing with law enforcement, I have NEVER been that un-easy dealing with a police officer.

    also a side note, I don't want this thread to turn into a "i hate cops thread" I can't stand that... this is simply an agrivation about 1 individual police officer.

    I have his badge number on the ticket, and would love to make a complaint... do these things ever get heard? would it be better to bring this up in front of the judge?


    I know a pn ticket doesn't harm your insurance, but i'm a little more then irritated at how it was handled.

    im not irritated I got caught.. im irritated by one specific officer.
    noone should have to feel threatened by a police officer.

    If that's the language he used, then he wasn't being professional or courteous in serving the public. I think you have a right to complain.

    yes.. if you have his number call the station lodge a complaint against him.. it will be noted on his record...

    now remember YOUR car is probably marked now when you do and he hears about it.. I mean how many camo blue cars are there around... ;)

    regardless.. I say put a civil complaint against him for his un-professional attitude...

    mind you with how cold it was last night i would be pissed having to respond to what he may have thought to be a major incident going down and to see a bunch of guys playing around..




    again... if you werent in an inhabited area this probably wouldnt happen... guys who go ripping up lots in neighborhoods should expect this to happen (without the words he used)

    I once got pulled over doing 14 over--and I told the cop I had to take a piss--which I did, and he let me off with a warning, and he was actually quite nice. Another time in the U of M area, a cop says I sped up too much to make the yellow light. I was being the DD for a bunch of my drunk buddies and it wasn't even my car. I didn't think I would be able to slow down in time, and this was during the era of those "red-light runner cameras" being used. The cop was very argumentative and just hostile and I was nothing but nice. He asked if we had been drinking, I said the other people were. Everyone was nice to him. He told me (the driver) to 'stop driving like a damn moron'--- which I thought was a bit uncalled for. Also though, he is probably used to dealing with a bunch of college kids that are always causing trouble. It sucks, but in my opinion, what can you do...?
    If you go to complain, they will probably ask what you were doing. In a way, what the cop was thinking was right, but he said it in a terrible way. I'm sure you are well aware of what is involved with getting caught doing that type of thing.

    In my opinion, if you complain, it will probably come back at you somehow. Probably just have to let it be known that the guy was a tool.

    Wow, that's sissy business. We had a group of St Paul Police tell us to go kill ourselves. He told AWDL to "Go back to your trailer and die" when he told him he was from Monticello. I handed him my military ID at the time, and he starts going on about how he'll tell my chain of command and my supervisor about it. I simply said "Really? You will, and what are you going to tell him? That I was sitting in a parked car in a parking lot talking to a friend? I'm sure he'll be pissed." He handed me back my ID and walked away. The very second you get snippy with a cop, expect backlash, especially if you have been ****ing around on private property. I try to talk to them like buddies, they are usually a little less hostile when you don't start your conversations with a chip on your shoulder...the military thing was an exception, those *******s were asking for it, every single person in that lot that night got told to go wreck their cars and die, but don't do it in St. Paul because he doesn't care.

    I also used to have the manual chapter and section that detailed how a police officer should act. I sent it along with my complaint...still not a word to date.

    I hate that "this is going to hit the blotter, your command is going to know, but if you just pay this outrageously expensive ticket and don't fight it, we wont say anything. Especially the **** they pull in California. They can shove it, I got a "possession of an open bottle" on the beach in San Diego a few months ago. It was half of a 12oz beer, sitting 6 feet away from me, and he never breathalyzed me. I went and sat in court with my Gunny, who just waved and smile at the Cop while me and 3 of my buddies (with the same ticket, for the same beer) got off scott free.

    It wasnt even our beer, we were sitting next to one of those public firepits and someone had left it, we werent aware of the law or we wouldve thrown it away.

    And Skarecrow, its really not a big deal what they said. They are humans too, and get pissed when people are doing "stupid ****", because they have to get out of their cars into the cold, do paperwork, bla bla bla. Get a thicker skin, just pay the fine or whatever, and find a better spot to go romp in next time.

    You can say whatever you want to a cop - as long as it is not threatening - just be prepared to deal with the hassles/BS of being taken to the cruiser or cop shop before getting to wherever you're ultimately going. If they initiate the trash talk you're well within your rights to return it. YMMV - use at your own risk and, ideally, have witnesses. This being said, swallow your pride and try to sweet talk your way out of the ticket if possible. If/when it appears a ticket is inevitable then let 'er rip!

    I've yet to meet a cop that didn't have a chip on their shoulder. They enter into a known high-stress career and then often complain about or react poorly to this same stress. W-T-F?! The vast majority of their calls are for nonsense so if they're going to act like ****s the majority of their careers then I have little respect for them. Respect is earned by action not a right bestowed upon them.

    You can file a complaint but don't expect the satisfaction of any meaningful actions being taken against the officer in question. It's too bad there isn't a sample of great experiences with the police to balance out these negative encounters. No, I don't *hate* cops, but I can *understand* why some do.

    at least they'll probably give you the forms to file a complaint, can't say the same for Eden Prairie.

    Yes, he was, and nothing came of it. NOTHING. I reported it, citing the code they violated, with my full statement of what happened, and nothing came of it.

    Is the lot closed to the public? Just because it is privately owned doesn't make it "private" under minnesota law. Owner's (which the plow driver isn't) permission doesn't actually change much unless he's closed it off.
    You could ahve been cited for careless or reckless driving. That is a misdemeanor so technically he could ahve hauled you to jail (he wouldn't have, that means work. Also, you bring people to jail for this, PD gets pissed. Jail costs $$$)

    It is still BS but that is hpow the law in Minnesota stands.

    If all he said is what you quoted, you don't really have grounds for complaint. Legally, you were wrong and the threat of arrest wasn't formed out of nothing.

    What city? I'm guessing burbs.

    Oh and in general, citizen complaints from neighbors will lead to a more serious response than they just driving by. If the neighbors called, that is pretty much all they need for a public nuesence type ticket.

    Its what happens when you call mayhem "shens" and pretend like you created it. The mayhem police got you. I hope its not too expensive of a ticket though. Anyone know if you can even fight one of these styles of tickets? is it considered a moving violation?

    Yep you got off pretty easy I must say. Lipping back to an officer will NEVER, I repeat NEVER get you anywhere. You can go ahead and file a complaint, but in reality nothing is going to happen.

    You should note to self, never stay in one lot for more than 5-10 minutes tops, anything over that your just rolling the dice.

    Subynate and I were driving in the snow storm in Duluth last night right behind a police car (actually an SUV). He turned right hard and intentionally drifted around the corner (was pretty sweet) across all the lanes of traffic. After swerving some more, he drove ridiculously fast for no reason. I just thought it was hilarious because they are always busting citizens for that kind of nonesense.

    To the OP, I honestly don't see where the officer was out of line or insulted you...? It sounds to me like your just pissed that you got busted. But if you really feel that you were insulted file the complaint, its very unlikely that any action is going to come of it but if it makes you feel better then fire away.

    Back in highschool when I had my 86 Cutlass I was physically pulled out of my car THROWN on the trunk, handcuffed, and had to listen to the white officer tell me about all the things he could do to me and get away with because I am, and I quote "young, black, and stupid". I never gave him any sort of lip, and I was extremely polite to him, so it seemed like he was just trying to flex his nuts and make himself feel better. My parents and I filed COUNTLESS complaints with the city of Maplewood, the Maplewood PD, and even wrote letters to the governor, and gov't officials to get some kind of restitution, but nothing ever came of it and I'm sure that same cop is still out there harrassing people.

    The recording idea is actually the reason I love the mic gain on my phones. If they are being beligerrant and you record them doing so, the public embarrassment is pretty powerful. On one hand, I can understand the frustration of having to do their job but if they don't like it they should quit. My dad was a cop, and he would be the first to tell you that you can't lose professionalism in that line of work. Situations only escalate when you make the suspect more pissed off than they already are for being caught. If you manage to get actual recording/footage, there's way more power in your court to at least have the officer spoken to about their attitude. Very few things will get them severely reprimanded, however.

    Maybe it's just me, bu honestly this just doesn't seem like that big of a deal to me. Then again I lived my teenage years in a California ghetto where the cops are real pricks about everything.

    ^^^^ I agree, comming from Chicago, this is nothing. I say you just leave it be. Nothing will really happen if you complain. It's his word Vs. Yours. Sucks, but it is what it is.

    I still think his badge should be stripped for a week without pay for an attitude adjustment. but thats just me.

    Yeah - nothing will come of a complaint - unless you frequent his patrol area, then you'll just get harassed more.

    It sucks when officers act like asshats.

    It got bad in my home town when I was younger. They'd pull me over in the rain and make me stand outside my car for like 20 minutes for BS. Once I even got pulled out of my car through the window and thrown on the ground - I thought I was going to jail for sure (didn't even really do much), but then the officer got a call and got in his car and sped off - just left me there on the street. lol

    To be fair - I was a hoodlum then and in a small town no less.

    cops are naturally ****s, I act like one if I know I'm not going to get ticketed, but if I know I'm in the wrong I'll act as nice as possible to get out of the ticket. Its worked before when I should have gone to jail for car related stupidity.

    /\ I'm not sure what that story is supposed to convey, but you can't intimidate cops. He made a decision on whether or not he wanted to deal with the paperwork before talking to you.

    Generally, in a close case (like, say 15 over), a cop decides based on attitude and his generally feeling about you.

    wait till you get pinned to the ground with pistols pressed against your temple, yelled at and told about the hollow point bullets they were aiming at my head over the fence and then after being let up (all while at a friends house in the rain just outside his garage door) the cop in charge grabs me form between my buddies and throws me against the wall yelling all sorts of stuff....

    I look at him and told him he was full of **** and that if he touched me again I would have his job... well you guessed it... he lost his job.. my buddy who was held down as well with a knee on his neck and gun to the temple all while having an asthma attack and they wouldnt let him up (his dad was a Detective Sergeant in the Fraud division)... he took him down....

    but I digress..

    what was it that happened again.. oh you got yelled at!!!
