i've had it!!!!!! with this guy

    I've tried to be very cival with this collection guy over an ancient card debt that shouldn't even rightfully be mine in the first place... and this dude makes it a point to call 6 times a day and inform me of all his threats and bla bla bla.

    you don't threaten me on christmas eve and continue to call over and over again....... thats where I draw the freaken line.

    aside from me contacting an attourney after the hoolidays for harassment...

    if anyone wants to give him a jingle in there spare time.. would be fine by me.. the less time he has harrassing people on christmas... or any other day of the week the better. This dude should be fired.

    I thought the law was that they could only call once a day if they talked to someone or left a message. That is why they normally hang up if the machine gets it. Then they can keep calling till they get a person. I could be wrong but I thought that was the law.

    nobody call the debt collector...skarecrow i totally understand your frustration but remember if you EVER want to build a case against him you can't go tainting it with posting his number and having people harass him...just my .02

    You are correct. One contact per day, but if the debtor doesn't answer they can keep calling until they get a contact. 2 times to 200 times. Most collection agencies use a dialer so the computer is actually calling you, not a collector. Once a contact is made the dialer sends the account to the collectors computer screen.

    IF there is any harassment or threats of any kind that can be used against the collector in court. Even if they eggagerate...that can be used against them.

    The best way to deal with a collection agency is to not ignore them, but take action, whether that's legal action or asking for a settlement on the debt owed. If the debt is old...real old...ask the collection agency if they bought the account from the original creditor. If they did you have a chance of settlement for less than the original amount owed. Get it in writing from them and ask they make a note on the agreement that the debt is settled 100% and it will be noted on your credit reports.

    Otherwise you can ask them to prove the debt is yours and have them send the documentation in writting. they have 30 days to have it in your hands. (they can still call you in the meantime)

    reminds me of Telemarketing calls.... haha I like them...most of the time I just give it to my 3yr old baby brother...hey, they did stop calling now though...hahah

    tell the collector the following:
    1 - all phone calls must cease and all communication must be via snail mail - the FTC rules say they must abide
    2 - you would like them to send you the full audit of the account in question

    you mentioned that the debt "might" not be yours in the first place. if you are specifically a joint account owner then you are responsible, but can sue the person that is truly responsible. if however you are only an authorized signor then they are just trying to get money from you that they can't get. the people in front of those screens really don't know laws and are just told "to get the money" in whatever way possible

    finally if your name was added to the account as a signor [owner] without your permission then you need to fill out a police report and file that with the "fraud victims department" at the collection agency

    i happen to know a bit about this and can help you out further if you need - not in any professional capacity but every bit helps

    Depends on the debt, but most debts die with the debtor. When the person dies, what they own is supposed to go towards what they owe. If they own nothing then the debts are written off as uncollectable. If they have no legal right to be going after a descendant, then they are liable to a harassment suit.

    At this point since he called you on Christmas Eve, I'd say go ahead and skip the "FTC rules" crap and get an attorney. The attorney can get the phone records and see how many times per day and what days he called you. I think your debt will go away beyond other things as it's harassment. I'm not big into litigation as I feel too many people sue for too many things but in your case, either this guy needs a good pistol whipping or his company needs a call from an attorney.

    If you can't get an attorney, maybe I can help you with the other part.
