modded car totalled in colorado...

    so i think my car is totalled in colorado...

    mods-

    vis cf hood
    motegi racing 18s
    piaa 520s converted to HID
    moving HIDs
    vf39 with all the ebay piping stuff, large ebay intercooler, and pro tune with cobb
    some nice stereo stuff
    enough that i want some of it back if possible/want money out of it

    a plow pulled out in front of my little brother (from behind a snow bank)

    tips for dealing with insurance?

    I'm thinking take it to a non-affiliate shop right away and get an estimate (see if it really is totalled). If it isn't i can deal with letting some shop out there do the repairs etc.- hopefully they won't mind replacing the VIS carbon fiber hood etc..

    If it is totalled what am i going to have to go through to get the parts off the car/buy it back?

    will i be able to get it towed back here and remove some stuff prior to totalling it? or will i have to buy it back in order to do that?

    any experience?

    that's what i thought- not if i buy it back! of course that could be a royal pita and not $ effective either though.

    I'm not sure but I think you have to have mods claimed with insurance for them to cover anything beyond the factory equiptment

    yeah, that is 90% always the case.

    I've actually dealt with quite a few of these situations in the past when modded cars were damaged and do actually have one of my cars appraised and with an extra "rider" policy to cover the modifications. Since this car is honestly my "winter beater" and the modifications aren't that extensive i have no extra coverage.

    They will cover the cost of factory equipment certainly and they may cover some extra stuff- i'm mostly concerned with the buying ti back process and how it being in colorado might effect that.

    I know if they just straigt up total it and take it away i'll be in a bad place

    otherwise, if it isn't totalled i'll likely be having to get it towed back here and be doing the repairs myself here (in which case i'm sure i can get a new cf hood or whatever for the bodyshops estimate of a painted stock one anyways)

    I think they call it a 'schedule'. That means you pay a fee to cover the $1000 turbo and you pay a fee for the $1000 rims. It goes for the radio too, but most insurance agencies will allow you to swap easy things like rims and radios. You may be screwed on the suspension.

    yeah, i know- it hasn't been as simple as it could be thus far, lol.

    at least i've been able to continuously get it back running right etc. and until now it hasn't been much of an issue other than a bit of added stress (having to repair it for deadlines etc.)

    it is definitely a blast to drive and made good power

    i think what i really need to figure out are the legal implications of towing it home prior to settling with insurance

    Is the other person at fault?
    If the other guy is paying for the damages, then they need to make you "whole."
    If your insurance is paying, then they pay per your contract which tends not to cover mods.

    Seems like with those brands its possible, try to track down purchase prices for everything.

    all items were purchased through paypal from various places, all install was done by me, i can't imagine i'd have any prayer of recovering for the ap/tune but that was done at db and i have receipts. Everything was purchased within the last 4 months too...

    wheels, hood and coilovers have no receipts though as they came with the car when purchased (maybe i can use that to my advantage in some way too though)

    i guess i could swap my blown vf22 on and the stock intercooler at the least (if i can a way to do it)

    sadly, i think the parts are only worth 2k or so to me (leaving the ap out) and that will make it almost enough, but not enough to make it worth driving to colorado and swapping some stuff.

    if i do take that option though- who has a ruined stock hood? awful wheels? stock suspension?

    Do note that you'll only get deprecated value for that stuff.
    That said reciepts are important.
    More important is who's paying.
    For non-destroyed parts, if they're not covered, you have every right to get them off. The exception is if its a part that replaces an OEM part, it needs an OEM part to replace it. For example, a gauge pod, you can just take, shocks need shocks to replace em (this is why i always keep my OEM parts)
    As for the AP, contact cobb. they've been pretty decent for totalled cars.

    nothing has been on the car for long at all- my insurance company has covered modifications up to $XXXX in the past and i assume they will do some of the same here with receipts.

    i am going to have him unmarry the ap

    sucks to hear that the car got hit. how badly is it damaged? will it still run? you could always do the buy back and part it out.

    If he pulled out in front of your brother my guess is your brother is at fault. Driving too fast for conditions would be the normal police reaction. Was there a ticket involved? Colorado doesn't appear to be a no fault state.

    I disagree...depending on the situation.

    If he(brother) was travelling down the highway, and the plow was entering/crossing the highway...it should be "failure to yield to oncoming traffic" for the other guy.

    Your brother should not be at fault if the truck pulled out in front of him.

    currently both are ticketed- it will become a battle. My brother shouldn't have been ticketed and will be making a court appearance (doesn't mean it won't stick)
