So what would you guys do?

    I bought a 22 gallon gas tank of EBAY from one of the Ebay stores. The tank in my El Camino is a 17 gallon tank so I wanted a bigger one. So I sent an email to the guy asking if it would fit. He said yeah and gave me the part number. Well, I didnt think anything of it and when it showed up really fast I was pretty happy and put it in the car. Comes time to put gas in it. 3 gallons out of my gas can and drove it to the station. Only heald anouther 14 gallons and I had to fight to get that in. So he sent me a 17 gallon tank under the 22 gallon part number. I emailed him my concerns and he says dont worry about it that it will fit anyway. Thats not the point, I wanted a 22 gallon. Price on the 2 tanks are the same new from him. I opened a dispute thru Paypal and we have been emailing back and forth. Paypal put a stop on the funds, I didn't. He wants to know what I want him to do.

    So tell me, if you sent the wrong tank to someone and it was your business to sell parts, what would you do to make your customer happy? The price of the tanks are the same from 17 to 22 and I cant send it back now. I dont need two 17 gallon tanks, I should have just left well enough alone and kept the small tank instead of spending 192.00 on a larger one. I have to do something soon so I guess I should just lick my wounds and cancel it.

    If he would have just said I'm sorry and gave it to me for his cost I would have just lived with it but now I'm kinda pissed.

    So am I wrong here?

    I mean this is totally his mistake, I think you should ship that thing back to him. (at his own expense of course.) and had him send you the right one.

    I agree w/ John 100%. It's not about the cost, it's about getting the product YOU wanted. I would absolutely take it back and send you the right one if it were my business.
    Thats the cost of being responsible I guess.

    It's full of gas now and been installed so sending it back wont work.
    I have to decide soon because Paypal will close the dispute if I dont file
    a claim. All he needs to do is say " hey I'll give it to you for my cost "
    and I would have been happy I guess. See another bad feedback heading my way for his fault, just like the only one I got sofar.

    If you send it back to him and have tracking info, and you have an open dispute, they will reward you your money back. Cause you don't have the item anymore, he does. He can't have both your money and the product. But if you're not sending it back to him, not sure. He should send you the correct size tha you wanted, or refund you your money, after you send him back the item at his expense . His mistake, his loss and expense.

    how do you know that he knew it was the wrong tank in the box? you dont.. getting it for his cost is just retarded, i'd give you 10 bucks max


    plus lets say he did send it back to the guy... lets say you did send it back and you get your money, minus the restocking fee etc so he actually made money and got the tank back

    why be happy at cost.... you had a 17 gallon tnak and wanted a 22 gallon.. he sold it to you under the pre-tense that it was a 22 gallon tank... He flat out lied...

    I would make him send you a new 22 gallon one, and then when the tank is empty enough to remove safely, send it back to him at HIS expense.. thats what I would say to ebay and to him.... if not I would take it further.. remember the comsumer is 'always' right!!!

    I dont know that he knew it was wrong. It was packaged very well and he has lots of tanks listed. I'm am guessing he didnt know. Brfore I bought I sent him an email asking about it fitting in a stock spot. He said it would and he gave me the item number. I dont want to go thru the hassel of sending it gas since it has gas in it now and not sure how you could even ship it. I didnt need another 17gl tank, had one in car. This is all his mistake and the more I think about it the more pissed I'm getting. Guess I should just turn it into Paypal and let them figure it out. He is in the wrong all together since he is the seller and listed it as a 22gallon tank.

    tell him you want 43.64 back.
    $192/22 = 8.7272
    8.7272 x 17 = 148.3636
    192 - 148.3636 = 43.6363

    Just say you want that back... he can deny it... and you can negotiate.
