stupid speeding ticket

    got a speeding ticket this morning, by the evil undercover black charger.

    he was on the inside shoulder of the highway.
    at first I thought it was as talled vehicle so I was slowing down anyway to "gawk", so I slowed it down to 65ish, (thought the speed limit was 70)
    he pulls right out behind me and cherrys me up.

    asked me how fast I thought I was going, and in an "I can't believe its this early and i'm getting pulled over rub my eyes kind of way I said "I slowed it to 65, I thought you were disabled and wanted to make sure I didn't hit you"

    he says, "well the speed limit is 60, and the problem is I got you with the laser doing about 80"

    so he takes my stuff back to the car... and I look at my gauges...
    I honestly dont think I was going 80, and after thinking baout it I was almost sure I wasn't doing 80.. at most 75.... which is still speeding mind you.. but it wasn't 80.

    so I was going to kindly ask him to see his laser reading when he came back to the car, he came back said "heres your ticket, look on the back for instructions bye"

    no time for anything with that guy.. but then what pisses me off... is he wrote "81" for speed on the ticket. grant you it's only a mile over what HE SAID I was doing. but I still feel the guy lied to me.

    and it's radar. you can't really argue a laser reading.
    freakin dirty bastard traffic cops.
    where were you the other night when el douche bag was going the wrong way on the highway?

    I'm pretty sure he did that so your going to be paying more than you would have vs the 20mph over.

    21mph over is another "bracket" up from 20mph over

    Don't just pay it, goto court and see if they will drop the speed a little for ya.

    I see this guy EVERY day on the way to work... and EVERY day he has someone pulled over.. random locations. I know he would be gunning for my car sooner or later.
    freakin ****.

    If I could fight the stupid laser I would. ALWAYS right before a ticket drops off my insurence I get hit with another... and it's usually a stupid fn ticket.

    lame...do you have a radar detector? that would have pissed him off even more, but you maybe could have avoided that all together. those things can sense lasers from a ways out. saved my ass a couple times.

    I drove down to minnetonka from plymouth and saw 2 different traps, the police must be bored on these weekend mornings and are in the revenue generating mode

    just drove EP to St. Cloud and back this AM. Counted maybe 10 troopers, each had someone pulled over.

    thats the plan...
    it just makes me mad cuz it was too freaken early to deal with a douchebag cop.

    so i'm going to ask for the log book and calibration log, and the fcc that should match all.
    if he wants to be a ****, fine... but hes going to work for it.

    You said radar and laser, which is it?
    Definitly go to court, given your story I'd let you plead to 65 in a 60 no problem. (See Minn. Stat. § 171.12 subd. 6 for why that's important. Also note that I might be in the minority of prosecutors here).
    Also, location?

    The real **** move of this cop is that by writing you a 81 in a 60 is that he triggered the 20mph limit which ups (doubles) fines and also reduces prosecutor's willingness to give CFD or stays of adjudication. However the telling you 80 and writing 81 is pretty normal, doesn't impact your fine.

    Laser tickets are a bitch and a half to fight and as long as the officer is 1/2 competent and the logs are solid, the state's gonna win. :(

    i bet you could still fight the ticket and win. if he told you that you were doing 80 and gave it to you as 81 thats gonna show that he might be pulling ish!

    It's ok. They suck. But you where going fast. Even if you are trying to get away from someone, if you go over the "limit" they'll tag you.
    Lucky you yours will not be as much as mine. $224 for 80 in a 55. He tagged me 88 but lowered to 80. I was accelerating on the on-ramp into 94. At least it's just a speeding ticket and not careless or reckless because I know I've done things that where careless and reckless.

    Drive with traffic if there are a good bunch of cars. Stay at or just a few mph over the speed limit if there are little to NO cars on the road. I'm always getting my speeding tickets when I'm testing my car's performance. I hate it... but well... it is the public road.

    You'll be fine. You may even qualify for that 1yr probation thingy, which I think is fake... but... eh.

    it's not the speeding ticket that really pisses me off... it was really my fault for speeding.

    what pisses me off is i'm sure I wasn't going what he SAID I was going, and then writing me a ticket for OVER what he said I was going...
    then on top of that not giving me a chance to say anything after giving me the ticket... and realizing today that the undercover has insanely illegal window tint on that car.... and tagging me from a very dangerous place to just "sit and tag people"

    I don't care if your a cop or not, if your going to give tickets for it, you shouldn't be doing it yourself.

    thats fine if your going to point out what i'm doing wrong, but the second a citizen trys to say the cop is doing something wrong.... instant "citizen has an issue with authority"

    it was a laser, i'm sure it was lidar.
    which pushes me even further to get a laser / radar scrambler... illegal or not.. I don't like being tagged for speeding when i'm MORE then in control of my vehicle at the speeds in which im driving. they claim they are out in full force tagging drunks. Obviously I wasn't drunk, im not in dangering anyones life, and the excuse to give me a ticket was simply to give a ticket. I was going LESS then the traffic around me ((which was a total of 3 cars.. not many) but still.. It heats me

    Oh a FWIW, in my reading of the law is that the state has to prove you were doing at least 80mph, as that triggers the 20mph double fine provision.
    While they "could" do that given that the margin of error on most laser guns is +/- 1 mph, a judge might see if differently.
    I also read the law as requiring them to prove 66mph to negate the dimiler issue. (You could go either way on this)
    If interested, read what are called the Apprendi line of cases (Named for a case of that name, 530 U.S. 466). Interesting cases that have to do with what the state has to prove to get certain punishments.
    (This matters because in "most" cases, the state only has to prove 66 in a 65, even if the ticket is written as a 74 in a 65. The max fine for all speeds is $300+fees and the fine schedule is just a recommendation and therefore isn't subject to Apprendi et al)

    Oh and you were no where near a careless, that triggers at 31mph over.

    That there is what he might win on. He said ABOUT 80 which means maybe a little more or less. All depends on the judge u get. Worth a shot though

    Nope, not fake. Just talk to a hearing officer and see what they do for you. Currently on it right now and when I went, they offered it to me right away. No questions asked since it was my first speeding ticket. $150 in "processing fees" and an hour of my time = worth it.

    I just thought of this not too long ago... I have a voice recorder on my cell phone that records up to at least 10 mins of stuff. If I ever get pulled over I'm going to record the entire conversation with the cop, and if he's being a prick or treating me unfairly (which obviously happens more often than not) I will be sure to tell him that I recorded everything he said before he walks away. Just a thought, because if you would have recorded what he said and showed that in court I'm sure you'd get it reduced. Either way, good luck!

    I dont know why but I feel like you have a few others, lol.

    Either way, sounds like he was a ****. Hope it all sorts out and you can get it lowered.

    +2 take it to court. Often they will let you plead to a lower speed/fine amount and keep it off your record unless you get another within a year. One positive of that is that I've known people on that who've gotten another ticket inside the year in different counties and gotten the same deal cause the second county didn't know about the ticket in the first county.

    Patrol cars are omitted from the window tint laws. I don't feel like looking up the statute right now but it's definitely in there.

    they usually don't submit these in the record untill another one is transmitted in...
    so your usually safe if they even submit or search for the thing.

    ^^^window tint :: absolutly stupid...
    but it wasn't an official patrol car... it was an undercover.
    maybe its the same thing, but it damn well shouldnt be ...

    same thing with cop cars chilling up on grassy hills, in the middle of the freaken road,

    somone kindly explain how a stationary squad car benefits society aside from benefiting the pockets of the city?

    I gave one out today, not fake, but rare in Anoka (you piss off Judges if you give too many out in Anoka)
    I tried to give 2 out, but the guy didn't want one and plead straight guilty. The hell?

    An unmarked car is probably subject to the rules of a standard patrol car, but i'm too lazy to look that up.
    There are some rules about how many unmarked traffic cars a dept can have, but i doubt a PD is dumb enough to break that.

    I've been pulled over by a burnsville cop who was in the wrong.
    I was pulled over for not stopping long enough at a stop sign.
    nuff said.


    they have 4 chargers... different colors..
    the black one is notorious in these parts for pulling people over.
    I have not came to work nor gone home without seeing him with someone pulled over.

    I was just "the guy of the hour"

    makes me mad when your a regular and they bide there time of getting you.
    I want to honk and wave at him so bad now when I see him like hes a good friend of mine.
