Tickets anyone? I got one and need help getting out of it.

    On my way to work on 35 S heading to work i get pulled over. Officer claims that i was doing 81 when i was only doing 68-69. Funny thing is that he tells me that this is a 55 zone not a 65. Now that i know that im going to court to argue that i never seen a sign that said its a 55 zone. Any advice on what to say when im in court? And what not to say?

    I got a ticket from comin back @ Iowa. Same highway 35 medford, Can't remember how fast I drove, but I walked away with a warning.

    Normally a public defender can get it off your record for a small fee. All courts have public defenders available.

    you should have ask for the radar gun reading. You have the right to see it. depends where on 35S the limited is only 55mph but most of the further south it is 65mph. Just tell the judge you didn't see the radar reading and you asked for it and the cop didn't offer or show it to you. That usually will be good enough and your off the hook.

    A lot of them don't use radar. They pace you for a few miles, call your license in and get info back on you even before they pull you over.

    just plead stupidity.
    ask if you can get it reduced to something that will not effect your insurance.
    trying to fight it hardcore should be reserved for when you get clocked over 100mph.

    and ps medford is one of the WORST places to speed.
    they seem to be out there all hours of the day...
    (not much else must be going on?)

    just a fyi, a cop DOES NOT have to show you his radar gun, i have talked with county prosecuters about this.

    Depends on what your looking for. Are you trying to get totally out of it, or just keep it off your record?

    To keep it off of your record: Go to the courthouse and ask to talk with the prosecuting attorney or Court Clerk(depends on how busy the courthouse is). Don’t admit to anything, just say that you would like to keep this ticket off of your record. Standard operating procedure is to offer you a way to keep the ticket off of your record if you don’t get another ticket within 1 year, with you still paying the amount due on the ticket(this will be based on the infraction and your driving history). Then, keep your nose clean for a year. You can also asked for a reduced fee, but the ticket will still go on your record.

    To get out of it: There are lots of references on the internet on how to get out of tickets. Most of them involve making sure the radar has been recently calibrated, and that the officer has current training on the equipment. If you schedule a court date and the officer doesn’t show up, you will also get off. However, if the officer shows up your pretty much screwed. I’ve heard of Judges actually increasing fines to ‘teach people a lesson’, and we all know police officers don’t lie(I’ll clue you in that motorcycle that was clocked at 205 a while back couldn’t physically go that fast).

    That's the big question. If your record is clean you can ask for probation. If you have recent prior tickets and want to keep it from going on your record, you WILL have to hire an attorney.

    That doesn't mean you will have a trial and get off. It's just that the threat of an attorney will cause the assistant state's attorney (ASA) to plea bargain your case down to a equipment violation or something dinky like that.

    Your attorney would, dutifully I must add, ask for several continuances, dragging the case out for months (or years!). Then he would force everybody to spend one hour plus in trial, during which he will verbally abuse the police officer and make him look like an idiot. ASAs don't have the time for that crap. They are like meter maids: get the money and get out. A trial takes time, and Minneapolis is too busy to bother with a trial for $150 or whatever your fine was.

    They will most likely plea it out as an equipment violation IF AND ONLY IF you have an attorney representing you at your court appearance.

    However, you will still pay the same amount in equipment fines (funny, eh). And you will pay $100+ for the attorney. Some charge by the hour, some a flat fee.

    And while I know nobody here would ever drive under the influence, the same goes for DUIs. An attorney can get your case knocked down to equipment violations, maybe reckless driving at worst. You'll pay the full fine, plus nearly the same amount for your attorney, but you won't have a DUI on your record.

    The system works if you're willing to pay to play.

    i believe all interstates within the 494/694 loop including itself have been changed to 60mph speed limit EXCEPT for the 35E stretch where it is only 45mph, according the officer that pulled me over...

    But still, speeding is not an intent crime. You are still liable in "accidental" speeding situations.

    I did this when I got a ticket in Minneapolis, it's called a continuance for dismissal or something along those lines. You pay the full fine (mine was $130), then if you don't get another ticket for a year, it never goes on your record. If you DO get another ticket within the next year then they BOTH go on your record.
    Do this option. It's cheaper, easier, and the net result is the same or better with MUCH less risk.

    Thanks for knowing that u are being a prick Tim...

    The guy is asking for help because he is an amature when it comes to dealing with tickets and what not....He is only asking for help, if u have no advice for him then thanks for checking this thread. Please don't misunderstand me about this, but I don't think "slow down" is excatly what he wants to here right now, when I know he is stressed about this.

    And to everyone who gaved there adivce thanks alot for the feed back that's excatlly what we were lookin for..not for people to tell him "slow down"
