tint ticket

    Hello everybody, I'm a lurker here and this is my first post. I have a 2001 Aspen White 2.5RS coupe, with some tinting. So today I was driving home and a highway patrolman that I had passed came up behind me saying that he wanted to check my windows. So I rolled down the passenger side for him (my drivers side isn't tinted) and he checked, and said that it was 1%( :eek: ). So anyway he gave me a ticket for it, and not a fix-it ticket, but a pay-up ticket. My rear quarter windows are even darker than my pass window, and I can still see through those, so what are those, .5%? But anybody that I've talked to says that they think that the pass window is about 35%, and the rears around 5%. So my question is this, is he legally obligated to give me a fix-it ticket, or is that a completely optional thing? Also, if I get another reading on the tinting, and it turns out that they are 35%, could I get the ticket revoked even though it is still illegal, based just on that the patrolman was wrong?     Legally he can give you a ticket/sitation for whatever the hell he wants. It's your obligation to defend yourself in a court appearance or pay up and move on.

    I would suggest looking up the statute that restricts window tinting on passanger vehicles. See what the law really says. Then you can see if its going to be worth your time to show up and defend yourself; or if you are wrong and should just pay the ticket.

    Even if you are wrong you have a possibility of getting off or lessening the sitation. Show up and defend yourself. A lot of times the cop wont even show up for such a minor infraction; so if its your word against his and he isnt present to give his word you can plee your case with the judge and say he was wrong.

    Also look up of window tint is a primary offense. If its not a primary offense then its not legal grounds to be pulled over for. So even if you were wrong; it could be thrown out becuase it was sited incorrectly.

    I'm no expert; this is just my opinon :)

    Legal limit is 50% for non-metallic tint all around on cars. Only on vans, SUVs, and trucks can you tint the rear and aft sides darker. Of course no tint on the windshield.

    that's the law - it says what everyone has been saying, but it also says that if you have a perscription you can tint it darker. It also doesn't say what the penalty is. I will check with a few cops I know and get back to you about the fix-it ticket versus pay-it ticket.

    where would I find out if window tinting is a primary offense? would I go to the DMV? or can I find it online somewhere?

    it does seem kinda bogus that he would pull tyou over for tint, although i have heard of it happening before. if you have exhaust or body mods som ecops are Bias about "ricers" and wil pul them over and bust out a ruler to get them on everything they can. (i know poeple that have had this happen). isnt 1% alittle too dark? thats 1% light transmission from out to in.

    i think that he doesnt have to give you a fix it ticket for tint. i have never heard of it before. good luck, i wanna know how this turns out. cause i might get tint soon.

    cant you have a 6" banner on the windshield?, what are rules bout perscriptions? what about metallic tints?

    Korsch - I talked to my police friend. He said he has the option to write a fix it ticket or a pay it ticket, but that he always chooses to write a pay it ticket because fix it tickets requre him to do follow up and make sure you got the tint taken off. He also said it is a primary offense.

    some cops also have a light gun where they shine something thru ur windows and it tells them how many % ur window tint is.

    With my past two cars I have recieved both fix-it tickets and pay tickets for tint on my rides and I have to say, "Give me a pay ticket over a fix-it ticket anytime!" yeah, the price for a pay ticket is crazy high for the violation, but taking off a $200+ tint off my car so I can get the cops to inspect it sucks worse. Plus the cost of putting the tint back on is the slap in the face. If I can pay one fine and be on my way, so be it!

    Korsch_RS You said the cop scanned yours at it read 1%? That means only 1% of the light would pass through it right? Limo tint 5% is dark as hell, I can only imagine what yours would look like. Can you take a picture of your ride and poster up? And what did the patrolman origionally pull you over for?

    That does look dark, but not bad when you open the door. I went 35 all around and no one has hassled me.... yet.
    That would deffinatly be equipment falure on the cops part..... or it was a little dirty too :p.

    That's pretty dang dark. I had 35% installed on the rears of my old car and it's not that dark. Maybe yours is closer to 10-15%?
    In any case, hope things work out in your favor!

    ^^^ I also had 35% tint on my rear and 50% on the side windows.
