w00t, no more work for a while..... arbitration pending.

    So, after 2 years of working at AT&T I was "let" go for being tardy...

    Well, at least that's what my manager wants people to think, but she didn't realize that I have about twice the IQ of her and now she's going to be the one scratching for a job. Let me explain:

    I go into work on Sunday at 12:25 pm and clock in. I was scheduled at 12:30pm. I work the day and everything is hoity-toity. Keep in mind that neither of the managers were on duty.

    I go into work on Monday at 1:26pm and clock in, was scheduled at 1:30. But, when I punched in (this is via an intranet program) I noticed my punch for Sunday showed 1:09pm. Finding it odd that the time was off, I ask my manager if there's been issues with the website. She acted quite weird and said no, then instantly got offensive and said I was late and that she had called to store on sunday at 12:30 to verify that I was there and "whomever" (this is in quotes since I talked to 3/4 of the on-duty staff and no one heard her call nor talked to her) she talked to said I didn't come in. If found this quite odd and instantly argued on my behalf, which she denied and claimed I was late.

    This right away set off alarms. So I called freind who's a manager at another store to see if there has been some way to see if there's shadiness going on with my punches. He explained that in the same program in which we clock in, we can go in and see all punches, edits, etc. that have been done by whomever at any given time.

    So I log in and sure enough see my original punch at 12:25pm Sunday. But, right underneath it I see that she edited my Sunday's punch on Monday morning at 9:43am to show I punched in at 1:25pm on Sunday. Then she re-edited it again a few minutes later to show I punched at 1:09pm (probably to decrease suspicion). I caught her red-handed and confronted her about it. She immediatly got very defensive and claimed she was calling IT right then to get it figured out. The rest of the day I didn't see her as I was on the sales floor and she was in her office. Later she Re-Edited her first Edit to Show 12:25, which was the original, correct punch. I still wasn't satisfied and already was typing up an email to the Union, HR, etc about said shadiness.

    Then, 10 minutes before we close, she calls me in back to say she has to let me go for tardiness. Now, I was flabbergasted, yet remained calm and collected and right away asked for union representation, she denied (federal offense). I asked to see recorded video footage of me walking in at 1:09pm instead of 12:25pm, she denied. I asked to see any verbal, written, or final warnings on tardiness (these have to be logged and filed per the union agreement) and she denied and said she didn't know where they were (since there never were any).

    I immediatly went to the sales-floor, took a screenshot of the internet program that shows the punches and all of her edits and emailed it to HR, the Union, and every high ranking District manager along with an extensive letter detailing her violations in that evening alone.

    All day yesterday I was on the phone with my HR rep, the Union rep, and my step dad who's an administrator of a Law firm and already has a few Employment Lawyers looking into it for me.

    So, that's about it. Should be a fun road here on out. The investigation is pending and eventually will lead to arbitration most likely. I was hoping for some cash settlement, but the lawyers said to let it play out and that a lawsuit would be last resort if the union and the company don't come to a fair agreement for me and the manager.

    p.s. anyone have a temporary job for me in the meantime?

    wow..this sucks for you but its totally awesome at the same time. i always wished i could do something like this to a manager that i thought was crap.

    You might be emotionally traumitized by these actions by management. Maybe your union should get you a month or two off with pay as a starter.

    haha, this thread delivers. i really should have thought about 'climbing' the corporate ladder. i want to claim some unemployent, but from what my buddy says, it takes a few months to collect and i'll probably have the job back by then. id much rather get 5 years worth of pay plus benefits, we'll see where it goes'

    Depending on when you go into sign up. But when I was laid off a couple years ago it only took about a month to get my first check. But your plan definitely sounds better. Unemployment maybe pays half of what you get now. It's no way to live.

    File for un-employment right away. There is a 2 week waiting period and then you get your checks after that. The biggest thing is that if this takes a couple of months you will still be getting some kinda of pay from them.

    I believe unemployment will pay $350/week with no taxes taken out. Granted you have to pay those taxes when that time comes around, so watch out for that. But that is the max they will pay, if its union, I think its the same.

    My Union unemployment allows up to $455/week for me. But definitely keep the taxes in mind for next spring.;)

    Well, its not the open/shut case as it should have been. Its kind of a long drawn out process thus far.
    First issue, it was brought to my attention that the cameras weren't working over that weekend, so there goes my 100% proof that I was there. I still have my punch to rely on though which really can't be refuted other than them claiming someone else punched me in, which I wouldn't put by the manager to falsify, she's already told enough lies and tarnished my rep.

    The only drawback is that the manager claims that someone said I wasn't there and is an eyewitness, which is complete bs obviously.
    So, that's about it so far. The union Is still building my case and I'm trying to get another rep to back me up as an eyewitness and get them to sign a notorized form.
