Nope. The difference is in how the brain deals with a phone conversation. In a phone conversation, the brain has to work extra time to handle the conversation because the person isn't there. It's said the brain is trying to imagine that person talking. With a live person this isn't an issue. (Yes, there's actual research behind this) It's not the conversation, it's not the phone. It's the phone conversation. Try it and get back to us.

There is always more to it than that For instance it is just as prevalent in human nature to make eye contact with those we are having conversations with. In fact the research you are mentioning is associated with this. Therefor while driving and having a conversation with people in the car you are also occasionally losing eye contact with the road and its obstacles to try to make eye contact with the passengers you are talking with. Which is worse, the extra brain cycles on a person trying to "imagine" the person they are speaking with or looking away from the road? There is plenty of room for interpretation in the research and room for plenty more of it. I still maintain having the extra hand free not holding up a phone makes a difference when reacting to situations. But then I'm a two-hand driver, not one of those one hand on the top of the wheel leaning over the center console stunnas. After all the track time and rally-x I've made it a habit to only remove a hand for shifting, changing the radio dial (which rarely ever comes on in my cars), or some other short activity related to the drive. I'm weird like that.
I actually knew someone that would turn around in the driver's seat to make eye contact with someone in the back seat. SCARY
I'm sooo happy about the law, it amazes me how many people do this. I honestly don't even talk on the phone while driving unless I absolutely have to....I know I'll get lost in the conversation and loose track of my surroundings.
There is simply no way to enforce this law. Unless of course someone is dumb enough to have their phone in plain sight while texting. Most people keep it down near their lap. If they want to make the roads safer they are better off taking your license away after 65, and banning all cars that take longer than 7 seconds to reach 60.
THIS! but i think if the older folk want to keep their license they have to prove that they are capable of driving normally by taking another drivers test/exam
Well, im sure they are going to find ways to enforce this legitamently... for instance: i know that i have done this one before... text/interwebbing on the phone, not looking at the road, swerving a tad into the opposite lane... They could pull you over for: Thinking your driving under the influence and now are able to do it for phone use. The other night after i got done with work around 2am i got pulled over for speeding... i was going 60 in a 55 on a country rd... He was all rude to me and asking if i had been drinking. I said no i just got done with work and he then got all smiley and said "he knew he recognized me from somewhere"( whatever...) Then he proceeded to tell me that he was mostly just looking for drunk drivers. They are sneaky and have their ways...and Thats a good thing. I'm very happy that this is being enforced!

I see enough people who are obviously texting to make it worthwhile. Also, you're expecting someone who is texting while driving to not so something else dumb?
My only point is this, there is no way for the officer to prove it. The burden of proof is always on the state, it is why they have radar/laser guns instead of the cop just being able to say you were speeding and write you a ticket. The officer can't simply say, "You were texting, here is your ticket". Prove it. You cant check the persons phone to see when/if they were texting last, you would need a warrant of some kind. It just really comes down to another reason for the officers to pull you over. Suspicion of texting while driving, which is going to quickly turn into, "so have you had anything to drink tonight?". I am really not against this law, but there are much much better ways to make the roads safer. Perhaps a merging class or two, and my aforementioned suggestions.
Don't need a warrant for an auto search. Just probable cause, which there is when you see someone ****ing with a phone like that. However, this law will actually probably be used in accident cases where you can get a subpoena quite easily.
lady at at&t store today ask me if i twd and if i do then getting the phone tilt probably wasn't a good idea...because it tilts...and then shows me the duo...lolz...
